Eric Hurst is a member and cofounder of Hurst + Sawyer LLC.  Eric’s law practice is focused on providing excellent legal advice to contractors, subcontractors, engineers, architects, and owners regarding the resolution of construction disputes and negotiating and drafting construction contracts.

Prior to entering the practice of law, Eric spent 16 years with Hurst Construction Co., Inc. in Murfreesboro, Tennessee.  Eric and his brothers purchased the company from their father in 1994 and successfully operated the business until 2000 when Eric decided to return to school.  While at Hurst Construction Co., Eric’s primary duty was to estimate and bid excavation, paving, and utility projects for commercial and governmental owners and contractors.  Eric’s extensive estimating experience gives him a unique perspective in resolving disputes and negotiating contracts.  Eric uses this unique perspective to help his clients identify the best path forward in disputes and contract negotiations.

Eric's construction dispute resolution experience includes disputes relating to mixed use developments, multi-family developments, hotel and resort developments, heavy civil construction, alternative energy power plants (wind and solar), hydroelectric power plants, landfills, demolition projects, and heavy industrial projects. He handles complex construction disputes in court and arbitration, including developing cases through depositions, document discovery, and e-discovery; preparing detailed claims; representing clients in mediation; and trying cases through both arbitration and litigation to award, judgment, or settlement.

Eric also has extensive construction industry transactional experience, representing owners, contractors, and subcontractors at the front end of construction projects.  Eric prepares and negotiates contracts of all varieties and project delivery methods, including design-build contracts, general contracts, subcontracts, design contracts, and consulting contracts.  Eric’s transactional work includes preparation and negotiation of contracts for industrial projects, large commercial projects, mixed use projects, hotel and resort development and renovation projects, and multi-family housing projects in various locations.
